Toscana, approvato il nuovo Codice del Commercio

​​​​​​​Le associazioni di categoria Confcommercio e Confesercenti promuovono a pieni voti il testo liberato dal Consiglio regionale. "Ristabilisce le regole della competizione nel mercato”, sottolineano i presidenti Anna Lapini e Nico Gronchi, che condividono molti punti della nuova legge. A riscuotere un particolare gradimento la proposta relativa alla questione delle sagre: “da molti anni chiedevamo limiti e prescrizioni per chi vuole organizzare eventi temporanei”. Bene anche la reintroduzione della Conferenza dei servizi per autorizzare le grandi strutture di vendita, così come per il legame tra permesso a costruire e autorizzazione alla vendita. Positiva la conferma del limite dei 15 mila metri quadrati per le grandi strutture di vendita e la conferma degli attuali limiti per le medie strutture.

“Il testo del nuovo Codice sul commercio approvato dal Consiglio Regionale ristabilisce le regole della competizione nel mercato”. Questa la convinzione dei presidenti di Confcommercio Toscana e Confesercenti Toscana Anna Lapini e Nico Gronchi, che condividono molti punti della nuova legge appena approvata dal Consiglio Regionale.

A riscuotere un particolare gradimento da parte di Confcommercio e Confesercenti è la proposta relativa alla questione delle sagre: “da molti anni chiedevamo limiti e prescrizioni per chi vuole organizzare eventi temporanei, da un tetto massimo di durata all’obbligo di coinvolgere gli operatori in sede fissa. Norme necessarie per mettere fine all’uso improprio di sagre e simili, che creano concorrenza sleale con le imprese e si ripercuotono negativamente sui fatturati e sui livelli occupazionali”.

Anna Lapini e Nico Gronchi si dicono soddisfatti per la reintroduzione della Conferenza dei servizi per autorizzare le grandi strutture di vendita, così come per il legame tra permesso a costruire e autorizzazione alla vendita. Positiva la conferma del limite dei 15 mila metri quadrati per le grandi strutture di vendita e la conferma degli attuali limiti per le medie strutture. “In questo modo si ristabilisce il principio di un governo condiviso del territorio sotto l’aspetto commerciale della grande e media distribuzione. Con questa scelta, della Regione, si vanno a salvaguardare, anche, i borghi e le piccole realtà locali; oltre che alla rete distributiva, del piccolo commercio, esistente” – commentano i due Presidenti.

Bene poi che il Codice del Commercio preveda modalità concertative per il riutilizzo a favore della rete distributiva tradizionale dei proventi derivanti ai Comuni dagli oneri di urbanizzazione per le nuove aperture di medie e grandi superfici. “È prevista la concertazione con le associazioni di categoria prima che le Amministrazioni decidano come reinvestire questi proventi” spiegano Lapini e Gronchi “l’obiettivo generale dovrà comunque essere quello di sostenere il commercio di vicinato impegnando le Amministrazioni locali nella riqualificazione di centri storici, aree mercatali, CCN o simili”.

Soddisfacente anche la parte che riguarda i distributori di carburanti: “in particolare per il mantenimento delle fasce orarie per il servizio assistito, che rimette al centro il ruolo del gestore”.

Per la prima volta hanno avuto definizione, in legge regionale, i Centri Commerciali Naturali; dando loro la valenza di soggetti che partecipano allo sviluppo territoriale; e si è individuato in maniera chiara il ruolo del piccolo commercio come elemento di riqualificazione delle aree più degradate delle città e per l’aggregazione sociale.

Particolarmente apprezzato, anche se non contenuto nel nuovo Codice del Commercio, il bando emesso dalla regione per il finanziamento delle iniziative dei CCN, anche nei piccoli e piccolissimi borghi.

“La Regione ha optato per il confronto continuo, l'equilibrio nelle scelte, per una visione chiara di sviluppo; tutti ingredienti di una norma che il mondo del commercio ha fortemente voluto e siamo fiduciosi che il nuovo Codice possa essere davvero uno strumento normativo efficace per promuovere lo sviluppo del settore nel rispetto dell’identità e della storia del territorio”, concludono i presidenti Lapini e Gronchi.
